Terms of Service

These Terms govern your use of Tuno’s concert discovery, social, calendar, and planning services. By creating or using an account, you agree to these Terms and our Privacy Policy.

1. Who may use Tuno

You must be at least 13 years old to use an account. If you are under the age of legal majority where you live, your parent or legal guardian must review and agree to these Terms on your behalf. You are responsible for the activity associated with your email sign-in and for keeping access to that email secure. Do not impersonate another person or create an account for someone else without permission.

2. What Tuno provides

Tuno helps people discover concerts, record interest or attendance, view social activity, and coordinate private Plans. Tuno is an early-stage beta and may change, pause, or discontinue features. We do not promise that every event, venue, artist, price, ticket, date, or availability detail is complete or current.

Tuno is not an event organizer, venue, promoter, or ticket seller. Ticket purchases and event attendance are transactions between you and the applicable third party and are governed by that party’s terms, policies, refund rules, and safety requirements.

3. Your content and permissions

You keep ownership of profile text, photos, Plan details, and other content you submit. You give Tuno a worldwide, non-exclusive, royalty-free license to host, store, reproduce, adapt, and display that content only as needed to operate, secure, improve, and provide the service according to your visibility choices. This license ends when the content is deleted, except for limited backup, security, legal, or abuse-prevention copies.

You represent that you have the rights needed to submit your content and that it does not violate another person’s rights or the law.

4. Acceptable use

You may not use Tuno to:

  • harass, threaten, defraud, spam, or impersonate others;
  • post unlawful, infringing, deceptive, or harmful material;
  • bypass access controls, rate limits, or account restrictions;
  • scrape, probe, disrupt, reverse engineer, or overload the service;
  • introduce malicious code or interfere with another user; or
  • use event data or the service in violation of third-party rights.

We may investigate suspected misuse and remove content, restrict features, suspend accounts, or preserve and disclose information when reasonably necessary to protect users, Tuno, or others, or to comply with law.

5. Third-party services and event data

Tuno may display information, images, and links supplied by Ticketmaster and other third parties. Their services are independent of Tuno. We are not responsible for third-party sites, content, products, availability, security, or conduct. Confirm important details with the official ticket provider or venue before relying on them.

6. Our rights

Tuno and its software, design, branding, and service content—other than your content and third-party materials—are owned by Tuno or its licensors and protected by intellectual-property laws. These Terms give you a limited, personal, non-transferable, revocable right to use the service as provided.

7. Account closure

You may export information and request account deletion from Privacy & data settings. Some limited records may remain where reasonably required for security, fraud prevention, legal compliance, dispute resolution, backups, or enforcement. We may suspend or terminate access for a material or repeated violation of these Terms, risk to the service or others, or legal necessity.

8. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNO IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND QUIET ENJOYMENT. WE DO NOT WARRANT UNINTERRUPTED, ERROR-FREE, SECURE, OR ACCURATE OPERATION, OR THAT AN EVENT WILL OCCUR AS LISTED.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TUNO AND ITS AFFILIATES, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, LOST PROFITS OR DATA, OR LOSSES ARISING FROM EVENTS, TICKETS, THIRD-PARTY SERVICES, OR OTHER USERS. TUNO’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TUNO IN THE 12 MONTHS BEFORE THE CLAIM.

Some jurisdictions do not allow certain exclusions or limits, so portions of this section may not apply to you.

10. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold Tuno harmless from third-party claims, damages, and reasonable costs arising from your content, your misuse of Tuno, or your violation of these Terms or another person’s rights.

11. Governing law and disputes

California law governs these Terms, without regard to conflict-of-law rules. Courts located in San Francisco County, California will have exclusive jurisdiction, except where applicable consumer law gives you the right to bring a claim elsewhere. Before filing a formal claim, please contact us so we can try to resolve the issue.

12. Changes and general terms

We may update these Terms as Tuno changes. If a change is material, we will provide notice appropriate to the service and ask account holders to accept a new version when required. Updated Terms apply prospectively from their effective date.

If a provision is unenforceable, the remaining provisions stay in effect. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent; we may transfer them as part of a reorganization, financing, acquisition, or sale of the service. These Terms and the Privacy Policy are the entire agreement about your use of Tuno.
